1. About these terms
These Terms and Conditions ("Terms") govern your use of the Kiroi Academy Gymnastics website and your enrolment in our programs. By enrolling a student or using our website, you (and, where applicable, the parent or guardian of a student) agree to be bound by these Terms.
Kiroi Academy Gymnastics is based in Melbourne, Victoria, Australia. These Terms are governed by the laws of Victoria and the Commonwealth of Australia.

2. Enrolment and class bookings
Enrolment in classes at Kiroi Academy Gymnastics is subject to availability. A booking is confirmed only once full payment has been received and a confirmation has been issued by us.
By enrolling, you confirm that all information provided (including the student's name, age, and any relevant medical conditions) is accurate and up to date. It is your responsibility to notify us promptly of any changes.
We reserve the right to refuse or cancel an enrolment where we reasonably consider it necessary for the safety or wellbeing of students or staff.

3. Fees, cancellations and refunds
All fees are due in advance as specified at the time of booking. Fees are non-refundable except as set out below or as required under the Australian Consumer Law.
Cancellation by you:
Cancellations made 7 or more days before the class or term start date are eligible for a full credit or refund.
Cancellations made fewer than 7 days before the class or term start date are not eligible for a refund, but may be eligible for a credit at our discretion.
No refund or credit will be provided for missed classes unless due to medical reasons, supported by a medical certificate.
Cancellation by us:
If we cancel a class or program, you will be offered a full refund or a credit towards a future class.
We are not liable for any other costs incurred as a result of a cancellation by us.

4. Liability and injury waiver
Please read this section carefully. Gymnastics is a physical activity that carries an inherent risk of injury.
By enrolling in our programs, you acknowledge and accept that participation in gymnastics activities involves inherent risks, including the risk of physical injury. You confirm that the student is medically fit to participate and that you have disclosed any relevant medical conditions, injuries, or health concerns to us prior to commencement.
To the fullest extent permitted by law, Kiroi Academy Gymnastics, its coaches, staff, and representatives will not be liable for any injury, loss, or damage suffered by a student arising from their participation in our programs, except where such injury, loss, or damage results from our gross negligence or wilful misconduct.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other applicable legislation that cannot be excluded.

5. Photo and video consent
From time to time, Kiroi Academy Gymnastics may photograph or video record classes, events, or performances for use in our marketing materials, social media, website, or other promotional purposes.
By enrolling, you consent to your child (or yourself, if an adult student) being photographed or recorded in the context of academy activities, and to such images or footage being used by us for the purposes described above.
If you do not wish to provide this consent, or wish to withdraw your consent at any time, please notify us in writing at [your email address]. We will make reasonable efforts to ensure the relevant student is not included in future recordings used for promotional purposes.

6. Code of conduct
We are committed to providing a safe, respectful, and inclusive environment for all students, families, coaches, and staff. All participants are expected to:
Treat coaches, staff, and fellow students with courtesy and respect
Follow all reasonable instructions given by coaches and staff
Arrive on time and be appropriately dressed for gymnastics activities
Not engage in bullying, harassment, discrimination, or disruptive behaviour of any kind
Respect the academy's facilities and equipment
Not use mobile phones or recording devices during classes without prior permission
We reserve the right to suspend or terminate the enrolment of any student or parent/guardian whose behaviour does not meet these standards, without refund, where we reasonably consider it necessary to do so.

7. Changes to these terms
We may update these Terms from time to time. Updated Terms will be posted on our website with a revised date. Continued enrolment or use of our website after any changes constitutes acceptance of the updated Terms.
